Cory of a Report of a Committee of the Honourable the Executive Council, dated 28th ~ August, 1857, approved by His Eacellency the Administrator in Cowneil on the following day. On a report from the Superintendent General of Indian Affairs, submitting for approval two deeds of surrender executed by the Chippewas of the River St. Clair, ~ respectively dated 21st July, 1857, yielding up all their right and title to a certain island ealled Keshabahahnelegoo Menesha, in the River St. Clair, and a certain © ) other island called ‘ Peach Island,” at the upper part of the River Detroit, to the end that the same may be sold for their benefit. . The Superintendent General observes that these surrenders contain no stipulation other than that the lands may be sold for the benefit of the band surrendering, and he conceives that it would be well to take care that these islands should not pass into the hands of others than British subjects. The Committee reeommend that the surrenders be accepted and enrolled in the ottices of the Provincial Registrar and of the Commissioner of Crown Lands. Certified. WM. H. LEE, To the Honourable Cae. Tuis INDENTURE, made the twenty-ninth day of November, in the year of Our Lord one thousand eight hundred and forty-three, between William Benjamin Robinson, of Saint Catherines, in the District of Niagara, Esquire, and Eliza, his wife, of the one part; and Her Most Gracious Majesty Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, of the other part. Witnesseth: that for and in consideration of the sum of two hundred and sixty-seven pounds seven shillings and six pence of lawful money of the Province of Canada to the said William Benjamin Robinson, in hand paid oy Her said Majesty at or before the sealing and delivery of these presents (the receipi whereof is hereby acknowledged) he, the said William Benjamin Robinson, hath granted, surrendered and yielded up, and by these presents doth grant, surrender and yield up unto Her said Majesty Queen Victoria, Her heirs and successors, all and singular those certain parcels or tracts of land and premises situate, lying and being in the Townsip of Rama, in the District of Simcoe, containing by admeasurement seven hundred and thirteen acres, be the same more or less, being composed of lots numbers twenty-six and twenty-seven in the frcnt concession on Lake Couchiching, containing one hundred and eighty-three acres, and lot number forty-six, in the said front concession on Lake Couchiching, containing eighty acres, more or less ; reserving one chain for road along the shore of each lake with free access to the beach for all vessels, boats and persons. Also, being composed of lots numbers fifteen and sixteen in the sixth concession, containing two hundred and fifty acres, and lot number sixteen, in the seventh concession, containing two hundred acres, all in the said Township of Rama, together with all and singular the hereditaments and appurtenances thereto belonging or in any wise appertaining, and the reversion 4 - = \ ; 223 and reversions, remainder and remainders, rents, issues, and profits thereof. To have and to hold the same, with tne appurtenances, freed and discharged from all incumbrances whatsoever, unto Her said Majesty Queen Victoria, Her heirs and suc- cessors, to the sole and only use, benefit and behoof of Her said Majesty Queen Vic- toria, Her heirs and successors for ever, upon trust, nevertheless, and to and for the use and purpose hereinafter mentioned, that is to say: upon trust to hold the same for the use of the Chippewa Tribe of Indians of Lake Simeoe, of which William Yel- lowhead is the Chief, residing with his tribe at Rama, in the District of Simeoe afore- said, and the said William Benjamin Robinson, doth hereby for himself and his heirs, covenant, promise and agree to and with Her said Majesty Queen Victoria, Her heirs and successors in manner following (that is to say): Tnat he, the said William Ben- jamin Robinson, at the time of the ensealing and delivery hereof, is and stands solely, rightfully and lawfuily seized of a good, sure, perfect, absolute and indefeasible estate of inheritance in fee simple of and in the lands, tenements, hereditaments, and all and singular other the premises hereinbefore described, with their and every of their appur- ‘tenances, and of and in every part and parcel thereof, without any manner of reserva- tions, limitations, provisoes or conditions, or any other matter or tning to alter, charge, change, encumber or defeat the same. And also, that he, the said William Benjamin Robinson, now hath in himself good right, full power and lawful and absolute au- thority to grant, surrender and yield up the said lands, tenements, hereditaments and premises, and every part and parcel thereof, with the appurtenances, unto Her said Majesty Queen Victoria in manner and form aforesaid. And lastly, that tne said William Benjamin Robinson and his heirs, and all and every other person or persons tyzhomsoever having or lawfully claiming, or who shall or may have or lawfully claim any estate, right, title, interest or trust, of, in, to or out of the lands, tenements, here- ditaments or premises hereby conveyed as aforesaid or intended so to be, with their appurtenances, or any part thereof, by, from or under or in trust for him, the said William Benjamin Robinson, or ‘nis heirs, shall and will, from time to time, and at all times, at the proper costs and charges in the law of Her said Majesty, Her heirs and successors, make, do, suffer or execute, or cause, or procure to be made, done, suf- fered or executed all and every such further reasonable act and acts, deed and deeds, devices, conveyances and assurances in the law for the further, better and more pet- fectly and absolutely conveying and assuring the said lands, tenements, hereditaments and premises, with the appurtenances, unto Her said Majesty Queen Victoria, Her heirs and successors, as by Her said Majesty, Her heirs or successors, shall be law- fully and reasonably devised, advised or required. Axp Kyow ve Furtuer, tnat the said Eliza, the said wife of the said William Benjamin Robinson, in consideration of the premises and also in consideration of the further sum of five shillings of lawful money aforesaid to her by Her said Majesty in hand well and truly paid at or before the ensealing and delivery hereof (the receipt whereof is hereby acknowledged) hath remised, released and forever relinquished and quitted claim, and by these presents doth remise, release and forever relinquisn and quit claim unto Her said Majesty Queen Victoria, Her heirs and successors, all dower and all right and title thereto which she the said Eliza the said wife of the said Wil- liam Benjamin Robinson, now hath or in the event of surviving her said husband can or may, or could, or might hereafter in anywise have or claim, whether at common law or otherwise howsoever, of, in, to or out of the lands, tenements, hereditaments and premises hereby conveyed or hereinbefore mentioned or intended so to be con- veyed, with the appurtenances, or any part or parcel thereof.
